Sgt. Stephen Williams: A Tribute to the Moody, Alabama Officer
Sgt. Stephen Williams, the Moody, Alabama police officer who was shot and killed on duty at a Super 8 hotel, was remembered as a good man who was a good teacher and mentor to other officers. A recent Facebook video posted by the Police Department captured him feeding a bulldog at a local park.
Chief Thomas Hunt called into CBS 42 television station and identified the slain officer as Williams, a 23-year policing veteran who had been with the Moody police force for three years.
“He was awesome. He was awesome,” said Hunt. “Just a good man. A good person. Funny to be around…He had been a sergeant with us…worked night shift for us. Very thorough in his paperwork, very thorough as a sergeant. He was a good teacher and a good mentor, and a lot of guys looked up to Stephen. He was a very good close friend.”
U.S. Attorney Jay E. Town released a statement: “Moody Police Sergeant Stephen Williams’ end of watch has come much too soon. Our condolences and prayers are with his family, friends, and fellow officers. His loss is a loss for all of Alabama. This serves as yet another heartbreaking and stark reminder of the perils encountered by law enforcement each day.”

Two Suspects Are in Custody in the Death of Williams, an Award-Winning Night Shift Sergeant
According to Hunt, Williams worked as a night shift sergeant for the PD. He said that the investigation was still ongoing, so he couldn’t release many details, including “how and why this happened.”
Hunt said that Williams was so-highly regarded he recently received a Keith Turner officer of the year award from the department.
“I ask everyone for prayer for the Williams family and the Moody Police Department,” the chief said. “As more information becomes available, we will be able to release more at that time.”
He added that he didn’t know what the initial call was about, but he confirmed the shooting happened during a law enforcement response to a Super 8 motel and that two people, a male and a female, are in custody.
The chief said that loud bangs heard by journalists at the scene were from “SWAT teams shooting tear gas into the actual hotel room.” Police were clearing it out to “make sure no other suspects involved,” he said, but there were not.
According to AL.com, police surrounded the hotel “for hours.” A man staying in the hotel told the newspaper he heard a sound from the room next door that sounded “like an AK-47.” Police have not specified the actual weapon used.
Williams Often Stopped to Feed a Local Bulldog
In January, the Police Department posted what is now a heartbreaking video. “Max knows his favorite Moody police officer has treats. He recognizes the cruiser and starts drooling,” the caption reads. “Champ is a one year old American Bulldog and doesn’t know his own strength. He gets so excited for our visit! He’s a good boy!! Show us your good doggos in the comments section. We are sorry we had picture comments disallowed but they should be turned on now.”
“Going to see my buddy. There’s my body, champ,” the officer says in the video, showing off the dog treats. “He’s going to come see me. He knows I’m his favorite policeman, and I have treats all the time.”
Although you don’t see the officer in the video, AL.com reported that the officer in the video was Sgt. Williams.
People Offered Prayers & Condolences as Word of the Officer’s Death Spread
People began filling the Police Department’s Facebook page with condolences about the officer. “I’m so very sorry! Please accept my sincere condolences for the tragic loss of an awesome person and Police Officer!” wrote one.
“Praying and God bless all of you for your selfless acts of service and dedication to protect our community! [prayer icon][love icon] wrote another.
“Prayers for my Brothers!” a man wrote.

Police officer shot and killed in the line of duty in Moody, Ala.; 2 suspects in custody
MOODY, Ala. (WBRC) - Authorities with the Moody Police Department confirm one of their officers was shot and killed in the line of duty Tuesday evening.
The officer is identified as 50-year-old Sergeant Stephen Williams. Chief Thomas Hunt says Sgt. Williams had been with the Moody Police Department for three years and was a 23 year law enforcement veteran. He was married and had three children.
“He was awesome. He was awesome - just a good man, good person, funny to be around, won officer of the year award a couple years ago. Made rank of sergeant last year, worked night shift for us. Very thorough in his paperwork, very thorough as a sergeant, good teacher and a good mentor. Lot of guys looked up to Stephen. He was a very good close friend," Moody Police Chief Thomas Hunt said.
It all happened at the Super 8 located at 2451 Moody Parkway/Highway 411 just off Interstate 20. Moody Police initially responded to the scene but multiple agencies were called in to assist.
We’re told Sgt. Williams was shot multiple times. No other officers were injured in the incident.
Police say two suspects - a male and female - are in custody. The scene is clear.
Sgt. Williams previously work with Calera PD for two and a half years, Alabaster PD for 15 years and Bessemer PD for more than a year and a half.
The investigation into Sgt. Williams’ death is being handled by ALEA and the St. Clair County Sheriff’s Office.
The Morgan County Sheriff’s Office shared video of the procession to bring Sgt. Williams’ body to Huntsville for an autopsy.
U.S. Attorney Jay Town released the following statement on the death of Sgt. Williams:

Gov. Kay Ivey released the following statement Wednesday morning:
"I am deeply saddened to hear Sergeant Stephen Williams was killed in the line of duty last night. He served the Moody Police Department with distinction and had a long, honorable career in law enforcement. In the end, he died a hero, fulfilling the oath he swore to do -- to uphold the community he served.
"Beyond his career in law enforcement, he was a father, and now, three children are left without their dad. We must not forget Sgt. Williams’ ultimate sacrifice was that of his family.
“This senseless violence must end. Every day, brave men and women who wear the badge put their lives on the line in order to keep us safe. We are greatly indebted for his service on our behalf. I ask the people of Alabama to join me in prayer for his family, friends and his brothers in arms.”
ALEA’s Secretary Hal Taylor released this statement Wednesday:
“We are deeply saddened to hear of the loss of yet another law enforcement officer killed in the line of duty. Sergeant Stephen Williams bravely committed 23 years of his life to protecting and serving his community. Our thoughts and prayers are with his family, friends and fellow officers of the Moody Police Department. His service and sacrifice will never be forgotten as we mourn alongside the entire law enforcement community.”
Attorney General Steven Marshall issued the following statement Wednesday:
“I was devastated to receive the phone call late last night that another one of our law enforcement heroes had lost his life. I have been slow to make a public statement today because, after a record-breaking year of law enforcement deaths in our state, words just seem so inadequate.
“Sergeant Williams was responding to a call for help at local hotel. He showed up, ready to assist, and was instantly shot dead. At this point, we have no reason to believe that Sergeant Williams’s shooting is related to the unrest we’re witnessing across the nation. Nevertheless, our state has been plagued in recent months by a lack of respect for law enforcement—most of whom are genuinely good men and women, from all backgrounds, doing an incredibly difficult job.
“Whether black or white, law enforcement or civilian, we are all Alabamians. None of us benefit from lawlessness. As I shared with Moody Police Chief Hunt last night, my prayers and deepest sympathies are with the department and Sergeant Williams’s family. District Attorney Danny Carr’s released this statement Wednesday:

Moody police sergeant killed in shooting at Super 8 motel
A Moody police sergeant was shot and killed after responding to a call at the Super 8 motel.
Chief Thomas Hunt identified the slain officer as Sgt. Stephen Williams. Williams, a 50-year-old father of three, had been a police officer for 23 years, the last three of those at the Moody Police Department. He began his law enforcement career at the Bessemer Police Department.
Williams was a father of three, according to a Gofundme account set up for the family.
Hunt said Williams had just been promoted to sergeant in the past year and was a recipient of the Officer of the Year award in memory of Keith Turner,who was shot to death June 27, 1998 and was the last Moody officer killed in the line of duty.
“Oh, he was awesome,’’ Hunt said of Williams. “He was just a good man, a good person, fun to be around.”
“He was very thorough in his reports, a good teach, a good mentor,’’ the chief said. “A lot of the guys looked up to Steve.”
"All I can ask is for everybody to please be in prayer for the Williams family and for the Moody police department,'' Hunt said.
Williams often fed an American bulldog, Champ, that recognized his patrol vehicle when Williams drove by the city park. “He knows I’m his favorite policeman and I have treats,” Williams said in a Facebook video.
The shooting happened shortly before 9:30 p.m. at the motel on Moody Parkway. A medical helicopter was sent for Williams, but the officer was instead taken by ambulance to UAB Hospital.
Two suspects - a male and female - were taken into custody. Police had the motel where the officer was shot surrounded for hours.
Amar Fouda just moved into the Super 8 on U.S. 411. He said it was about 9:25 when he heard a lot of noise in Room 214, which is directly next to his room.
“I heard like an AK-47,’’ he said. Fouda said he ran into the bathroom and hid in the tub.
When he saw blue lights come on the scene, he looked outside. “I saw one of the officers, he was down,’’ Fouda said.
He said he didn’t know why police were at the motel but said his neighbors “had been making a lot of noise.”
Hunt said the Alabama Law Enforcement Agency and the St. Clair Sheriff’s Office will be heading the investigation.

Veteran charged in hunting accident that killed 11-year-old Alabama boy
A veteran has been charged in connection to a deadly hunting accident that killed an 11-year-old boy.
The Jefferson County Sheriff’s Office on Tuesday announced a reckless manslaughter warrant against Joshua Stewart Burks, 35. He is charged in Friday’s death of Troy Ellis of Trussville. The boy’s father, Obed Ellis, is a football coach at Mortimer Jordan High School and was also injured in the shooting.
Father, son, Burks and another man began turkey hunting at daylight Friday on Ellis’ hunting land off Cedar Mountain Road in North Clay. The hunt was organized by a group that sponsors hunts for wounded veterans and Ellis was acting as a guide.
Burks, an amputee, is U.S. Marine Corps veteran and a middle school teacher in Mobile County. He surrendered to the Jefferson County Jail Wednesday on $15,000 bond.
The shooting happened about 9:30 a.m. Troy was brought down from the mountain and those with him sought help. He was pronounced dead on the scene.
"Mr. Burks in no manner intended for this horrible accident to occur and feels extreme sorry and hurt for the Ellis family,’’ said his attorney, Jonathan C. McCardle. “While I feel criminal charges should not have been brought forth here, we look forward to working with the Jefferson County District Attorney's Office in bringing a resolution for all involved in this horrible accident."
Troy attended Cahaba Elementary School. "We were devastated to hear about the hunting accident and the loss of our precious 5th grade student. Any loss of life is tragic, especially during these times of isolation when we can’t grieve together,'' said Trussville City Schools Superintendent Pattie Neill. “The Ellis family and the Cahaba family are in our thoughts and prayers, and we are reaching out to help in any way we can.”
A GoFundMe to help the family has already raised more than $44,000. A vigil held Sunday night outside the family’s Trussville home drew hundreds.
A graveside service will be held on Wednesday, May 6th 2020 at 1 p.m. in Wetumpka.

Emanuel Bryant Guilty Of Manslaughter In Dawsey Shooting Death
A Houston County jury deliberated more than four hours before finding Emanuel Bryant guilty on manslaughter charges in the shooting death of Daniel Dawsey in May of 2014. Bryant faced a murder charge, but the jury found him guilty on the lesser included charge of manslaughter.
The defense called into question the credibility of prosecution witnesses during the trial. A sentencing date is set for August 26th, where Bryant could be sentenced to life in prison.

‘Such a loss’: Wetumpka grieves death of 11-year-old killed in Jefferson County hunting accident
WETUMPKA, Ala. (WSFA) - The Wetumpka community is grieving after the loss of a Wetumpka native’s son.
“It is just a sad, sad time to lose someone this young,” said Mayor Jerry Willis
Willis was devastated when he learned 11-year-old Troy Ellis had died. Troy’s father, Obed, is from Wetumpka. He played football at Troy, then he came back and coached at Wetumpka and Prattville before moving to the Birmingham area.
Troy Ellis was hunting with his father and another pair of hunters on May 1 when he was shot. An arrest warrant for reckless murder has been issued for 35-year-old Joshua Stewart Burks of Mobile in the case.
“Such a loss to his family," Willis said. "Such a loss to friends, and to our city because Troy’s dad, Obed, grew up here and was so much a part of this city.”
Willis said this is not the first time the Ellis family has faced tragedy. Obed’s father was killed in a car crash when he was a child. As they did then, Willis says the city of Wetumpka will rally around the Ellis family.
“I know that they are believers; I know that they trust in God," he said. "So, we are going to continue to support them and ask everyone else if they will pray for this family, and pray often for this family.”
Troy Ellis will be laid to rest in Wetumpka next to his grandfather. Willis says people plan to line the road from the country club to the cemetery to show their support for the Ellis family.

Mrs. Barbara White Tidwell, age 65, of Dadeville, passed away on Friday, April 17, 2020 at her residence. She was born on May 30, 1954 in Dadeville, Alabama to Durell White and Dorothy Huff White. She was a member of Calvary Baptist Church. Barbara loved her family very much, especially her grandchildren and was happiest when they were all together. She enjoyed sewing and doing crafts. Barbara enjoyed the simple things in life. She loved sitting on her back porch, reading and planting flowers.
She is survived by her daughters, Farrah Meadors (Shane) of Dadeville and Ashley Payne (Michael) of Auburn; grandchildren, Jalyn Grace Meadors (Preston Dasher) and Brody Garrett Meadors; sister, Susan Turner (Barry) of Alexander City; brothers, Bobby White of Birmingham and Ronnie White of Alexander City; nephew, Brandon Turner (Amber), Garrett White and Hunter Baker; nieces, Sela White and Ana White; great-nephew, Levi Turner; and great-niece, Adalynn Turner.
She was preceded in death by her parents; and husband of 20 years, Willie Tidwell.

He was born on December 19, 1958 in Red Level, Alabama to William Wesley Tidwell and Cassie Joe Dubose Tidwell. Willie was a hard working man, with a heart of gold that could fix anything. He was an avid Alabama fan and he loved fishing, camping and anything Elvis. Willie’s family was his world and he loved his grandchildren immensely.

Montgomery man fatally stabbed
MONTGOMERY, AL (WSFA) - A man was fatally stabbed and now Montgomery police are investigating his death as a homicide.
According to Capt. Regina Duckett, officers, and medics went to the 2600 block of Endicott Drive shortly after midnight for a possible stabbing. At the scene, officers found George Tucker, 41, who had been stabbed.
Tucker was transported to Baptist Medical Center South where he was pronounced dead, Duckett said.
An investigation shows the stabbing happened during an argument over a woman. No arrests have been made at this time.

Dadeville police chief: husband, wife found shot dead inside home
DADEVILLE, Ala. (WSFA) - The Dadeville Police Department is investigating an overnight double homicide, Police Chief Jonathan Floyd confirmed.
Floyd says officers received a call between 7 and 8 p.m. about two deceased people. When police arrived to the scene, Floyd says they found two people dead due to apparent gunshot wounds inside a home within the 200 block of North Barrett Street.
Floyd has identified the two as husband Willie Tidwell, 61 and wife Barbara Tidwell, 65.
Earlier Saturday, Dadeville Mayor Wayne Smith confirmed to WSFA 12 News he knew the victims in the incident.
Floyd says anyone with information is asked to call Dadeville police. Floyd also confirmed Dadeville PD is also working with Birmingham and Auburn police as well.

Georgia man suspected of killing four in 100-mile crime rampage
A Georgia man is suspected of killing four people during a 100-mile, 36-hour crime spree across Alabama, according to reports.
The spree began early Friday, when police believe Derrick Lee Hightower, 32, fatally shot Nancy Nash, 54, in Auburn, possibly because she interrupted a burglary, WVTM reported. Her body was found later that day in Auburn, near a burning truck.
Hightower then allegedly gunned down a couple in Dadeville after a possible robbery at their home. Police have identified the pair as Willie Tidwell, 61, and his 65-year-old wife, Barbara. Formal charges have yet to be filed against him in connection with that incident.
Hightower’s alleged rash of crimes continued in Birmingham, where police say he gunned down Antione Harris, 36, early Saturday during a home invasion, AL.com reports.
Hightower, who was shot in the arm during an exchange of gunfire with cops before he was arrested Saturday afternoon in Birmingham, is also suspected of robbing three people a day earlier at an urgent care office in Chelsea, WVTM reports.
“We are very thankful that this individual has been arrested and is no longer a danger to everyone,” Shelby County Sheriff John Samaniego told the station.
Kentrice Symonee Hill, 21, of Birmingham, was also charged with capital murder in Nash’s death. Her relationship to Hightower is unclear, as is the motive for the man’s alleged 36-hour rampage that spanned roughly 100 miles along US 280, AL.com reports.
“All of these families have been impacted,” Assistant Auburn Police Chief Clarence Stewart told the website. “What possibly has he gone through in his life to lead to this? I believe we are products of our environment and it makes me wonder what brought him to this point.”

Nick was a graduate of St Clair County High School in 2006 Graduate of the Alabama Fire College – Tuscaloosa Graduate of the UAB EMT School Worked as a firefighter for the city of Margaret, Alabama and Branchville, Alabama. Graduate of Northeast Alabama Law Enforcement Academy, Class 174. Served as a Police Officer for Ashville, Alabama, Trafford, Alabama, a K-9 Officer for Kimberly, Alabama. Nick was always doing something. Not only did he serve as a police officer, he owned and operated Southern Lawn Care and Xtreme Pressure Washing LLC. He was a Ham Radio Operator. He was an ordained Minister and he married his sister Ashley and brother-in-law, Chad. Nick had so many accomplishments, when he put his mind to something, he did it. He always had a smile on his face, and it lit up a room. He never met a stranger. He had a big heart and he loved big. He was also quite the jokester, he always knew how to make you laugh.

‘His legacy will not be forgotten’: Fallen Kimberly police officer Nick O’Rear laid to rest
A 33-year-old police officer shot to death nearly one week ago was remembered Monday for his kindness, his devotion to policing, his mischievous sense of humor and, most of all, a selfless love for others.
Kimberly police officer Nick O’Rear was fatally shot Tuesday night during a pursuit on Interstate 65 South. He was pronounced dead early Wednesday at UAB Hospital.
“Nick lived life big, he lived life to the fullest,’’ said the Rev. Duane Terpo, the music minister at Church on the Bluff in Hoover and the father of O’Rear’s pregnant girlfriend. “He had a servant’s heart like someone I’ve never seen before. His legacy will not be forgotten."
More than 400 law enforcement officers representing least 50 agencies from around the state and beyond – some from as far away as Boston and New York City – joined the throng of mourners at Gardendale First Baptist Church Monday. Shortly before the service began, the officer’s held a Final Salute, filing one-by-one by O’Rear’s flag-draped casket.
In a particularly poignant moment, O’Rear’s K9, Stella, was the last officer to enter the sanctuary to honor her handler. “I’ve always heard about the thin blue line, but I never understood it until this happened,’’ Terpo said. “It is an amazing thing."
O’Rear was a father to two – daughter Everlee and son Briar. His third child, son Weston, is due in a few months.
The officer graduated from St. Clair County High School in 2006 and later graduated from the Alabama Fire College in Tuscaloosa as well as UAB’s EMT School.
O’Rear worked as a firefighter for the cities of Margaret and Branchville before graduating from the Northeast Alabama Law Enforcement Academy and beginning his law enforcement career. He served as a police officer the cities of Ashville and Trafford before joining Kimberly’s force in February 2019, where he completed training both as a sniper and a K9 handler.
Additionally, he was a ham radio operator and owned and operated Southern Lawn Care and Xtreme Pressure Washing LLC. He was an ordained minister. “Nick had so many accomplishments. When he put his mind to something, he did it,’’ his obituary reads. “He always had a smile on his face, and it lit up a room. He never met a stranger. He had a big heart and he loved big.”
The shooting happened about 10 p.m. Tuesday, Feb. 4, when Warrior police attempted to stop a vehicle for an expired tag. When the vehicle would not stop, Kimberly police joined the chase. Authorities said the Kimberly officer got in front of the suspect – now identified as 37-year-old Preston Johnson - and that’s when shots were fired. A Warrior resident who lives near the shooting scene said she heard 10 to 12 shots in rapid succession.
O’Rear was struck in the head while driving and crashed his cruiser a short distance away. He was rushed by Warrior firefighters to UAB Hospital via police escort and pronounced dead at 1:15 a.m. Wednesday.
His death marks the first time a Kimberly police officer has ever been killed in the line of duty.
Johnson, who has a lengthy criminal history, was taken into custody within hours of the deadly shooting. Multiple law enforcement agencies took him into custody early Wednesday on U.S. 78 near Dora.
The Rev. Tony Barber, pastor at Church on the Bluff, said he had only known O’Rear for several months and said he was “an easy person to like.” While he’s heard many say, “It must have been Nick’s time,” Barber said he disagreed.
“I don’t happen to think it was Nick’s time,’’ he said. “Evil is real. Evil is in this world, and evil took the life of Nick O’Rear.”
“The only answer to evil,’’ he went on to say, “is to know Jesus Christ.”
Kimberly Fire and Rescue Capt. Robert Mashburn said O’Rear was one of the “most unique individuals you'd ever meet," and said he “jumped in with both feet” after joining the force nearly one year ago.
"There's some who bring a light so great to the world that even after they have gone, the light remains," Mashburn said. “He was a man of honor. I owe it to him to be worthy of his sacrifice, as do you.”
Following the service, a lengthy procession made its way from Gardendale to Jefferson Memorial Gardens in Trussville.
Governor Kay Ivey on Friday ordered flags be flown at half-staff on Monday until sunset in honor of the fallen officer. “On this somber day, we remember the life of Kimberly Police Officer Nick O’Rear,’’ Ivey said Monday in a social media post. “We will lift his loved ones, comrades and the city of Kimberly in prayer as Officer O’Rear is laid to rest.”
Terpo said that he saw O’Rear at church on the Sunday before his slaying.
“There was a peace about him that day I can’t explain,’’ Terpo said. “I’d never seen that before. It’s almost as if God was preparing Nick for what was to come.”
“Nick’s life was taken way too soon. We can’t make it through this alone,” he said. “But I’m reminded of God’s promise – He never leaves us and he never forsakes us.”

Man accused in Alabama officer’s killing fired AK-47 out front, back of his BMW, agent testifies
The suspect in the deadly shooting of an Alabama police officer last month grabbed an assault rifle from the back seat of his BMW and opened fire from the sedan when he realized police were in front and behind his vehicle on Interstate 65, according to an SBI agent.
Preston Johnson, 37, was in court Thursday for a preliminary hearing before Jefferson County Circuit Judge Alaric May in the February slaying of Kimberly police Officer Nick O’Rear and the attempted murder of Warrior police Officer Lee Glenn. Johnson is charged with three counts of capital murder, attempted murder and discharging a firearm into an occupied vehicle. He also has been indicted on federal gun charges.
The shooting happened Tuesday, Feb. 4, on Interstate 65. O’Rear, a 33-year-old father of two with a child on the way, was struck in the head. He was pronounced dead in early the next morning at UAB Hospital.
Jefferson County Chief Deputy District Attorney Joe Roberts and Deputy District Attorney Deborah Danneman are prosecuting. Johnson is represented by appointed attorneys David Simpson and Wakisha Hazzard.
Family members of both O’Rear and Johnson attended Thursday. Johnson’s family, who have not made any public statements about Johnson or the accusations against him, declined to comment. Johnson smiled at them when he was brought into the courtroom.
State Bureau of Investigation Special Agent Pete Acosta, the lone witness in Thursday’s hearing, testified about witness statements. That night, Glenn – the Warrior officer – was parked alongside I-65 and spotted an approaching black BMW. When the driver of the BMW – later identified as Johnson – spotted the patrol cruiser, he began to drive erratically. Glenn activated his emergency equipment, Johnson failed to stop, and a chase began.
Revealed in Acosta’s testimony today: A woman civilian was doing a “ride-along” with Glenn.
As Glenn pursued the black BMW, testimony showed, O’Rear heard the radio traffic and joined in. When he entered I-65, he was ahead of Johnson’s vehicle and Glenn was behind the suspect.
Acosta testified that a woman was with Johnson. He had picked her up and was taking her to her mother’s house. That woman told police that when Johnson noticed a police officer behind him, he told her to grab a gun. She refused. At that point, she told agents, Johnson reached into the back seat and retrieved a long gun, which court records state was a Norinco Mak-90 AK-47.
Johnson, according to the witness, fired through the front windshield at O’Rear’s vehicle and then fired through the back windshield at Glenn’s vehicle. Once they realized there were no more police officers behind them, they exited the interstate and parked the BMW behind a church. Johnson then made some phone calls and the pair was picked up by another man and woman in a white GMC pickup truck.
Johnson’s passenger told police they left multiple items in the woods near where they had left the BMW. Acosta said investigators recovered the assault rifle, a Glock 9 mm handgun, a set of keys, a military camouflage jacket, a purse, a backpack and some narcotics.
Acosta said investigators had quickly identified Johnson as a suspect because of the vehicle’s description and law enforcement’s previous contact with him. A lookout bulletin was issued first to law enforcement only, but later a Blue Alert went out statewide.
Authorities were able to determine that Johnson had switched vehicles because the wife of the man who picked up Johnson was tracking him via social media, according to court testimony. The wife said she had called her husband to see if he was coming home and he told her he had to go pick up Johnson who had either had a wreck or was having car trouble. The wife then saw news bulletins that Johnson was wanted, and she called police to tell them that Johnson was with her husband. It wasn’t clear in testimony how the woman was tracking her husband’s movements, but Acosta said it wasn’t through a phone app.
Johnson and the other man and two women were taken into custody shortly before 1 a.m. on Feb. 5 on U.S. 78 near Dora. Jefferson County deputies, Adamsville and Sumiton police were among those at the arrest.
Johnson’s passenger picked Johnson out of a photo lineup as the man she was riding with. After questioning, Johnson was taken to the Jefferson County Jail and the other man and two women were released without being charged.
Acosta testified that both police cruisers – those belonging to O’Rear and Quinn – were heavily damaged by gunfire. Additionally, O’Rear’s vehicle suffered additional damage from crashing into the interstate median after he was shot. O’Rear’s rear window was shattered by gunfire, and there was blood evidence throughout the vehicle, including on O’Rear’s headrest.
Simpson, one of Johnson’s attorneys, argued that it was premature to charge Johnson with capital murder. He pointed out that the investigation is ongoing and said that the woman riding with Johnson had not, and could not, yet be eliminated as the person who fired the shots.
“This is a bit premature,’’ Simpson said. “There is another viable suspect.” He said Johnson was under “substantial hardship” facing charges of killing a police officer.
Prosecutor Roberts, however, said there was substantial evidence against Johnson to send the case to a grand jury for indictment consideration. The judge agreed and bound the case over, ordering Johnson remain held without bond.
Johnson has a lengthy criminal history, according to state and federal court records.

Suspect in killing of Kimberly police officer indicted on federal gun charges
The suspect in the fatal shooting of a Kimberly police officer has now been indicted on federal gun charges.
Preston Johnson, 37, is charged federally with three counts of being a felon in possession of a firearm. The indictments were issued in late February, and announced by federal authorities on Monday.
Johnson already is facing state charges of capital murder in the February slaying of Officer Nick O’Rear, who was fatally shot that Tuesday night during a pursuit on Interstate 65 South. Johnson is also charged with attempted murder for shooting at the Warrior police officer who initiated the pursuit of Johnson.
According to the federal indictments, Johnson on Oct. 31, 2019 was in possession of an Anderson AM-15 5.56mm rifle. At the time he was in possession of that weapon, he had already been convicted in 2017 of unlawful possession of a controlled substance in both Cullman and Morgan counties, as well as first-degree theft in Cullman County in 2005.
On Feb. 4, 2020, the night O’Rear was shot, authorities say Johnson was in possession of a Norinco Mak90, 7.62 mm rifle. And on Feb. 5 – which is when O’Rear was officially pronounced dead and when Johnson was captured – Johnson was in possession of a Glock Model 19 9mm pistol.
“Violent convicted felons with firearms will answer to federal charges in the Northern District of Alabama,” said Northern District of Alabama U.S. Attorney Jay Town. “We are indebted to the brave law enforcement officers who put themselves in harm’s way to ensure that this violent criminal was brought to justice.”
“ATF’s focus on removing illegally possessed firearms from prohibited individual’s aids in reducing the potential for violent crime,” said ATF Special Agent in Charge Marcus Watson.
The maximum penalty for being a felon in possession of a firearm is 10 years in prison and a $250,000 fine. ATF investigated the case along with Alabama Law Enforcement Agency and several other local law enforcement agencies, which Assistant U.S. Attorney Robert J. Becher, Sr. is prosecuting.
O’Rear, 33, was a father of two with a third child on the way and had been a Kimberly police officer for a year or less. “Everybody loved him,” Kimberly Mayor Bob Ellerbrock said. “He was a tremendous asset to our community.”
Johnson has a lengthy criminal history, according to state and federal court records.
According to state court records, Johnson was arrested in Cullman County on Oct. 31, 2019 on charges of possession of drugs with intent to distribute and possession of drug paraphernalia. Police found him with 13 grams methamphetamines, suboxone, baggies, and scales. Records state Johnson was also in possession of a stolen Corvette.
Cullman County Sheriff Matt Gentry at the time told AL.com that Johnson also had an AR-15, which he was forbidden to have because he is a convicted felon.
That case had a hearing set for March 2, records state.
The Cullman County District Attorney’s Office on Wednesday filed a motion to revoke Johnson’s bond on those drug charges. Though he had been arrested on 20 different charges dating back to the early 2000s, and convicted of at least six felony charges, he was released on his own recognizance just five days after his Oct. 31, 2019 arrest.
“While on bond…the defendant has been booked into the Jefferson County Jail on a charge of capital murder of a Kimberly police officer,’’ wrote Cullman County Assistant District Attorney Jefferey H. Roberts.
In addition to those pending 2019 cases, Johnson pleaded guilty in 2017 to drug possession with intent to distribute and sentenced to 75 months in jail. His attorney asked he be able to take part in a diversion program, however a judge denied that request.
In 2011, Johnson pleaded guilty to drug possession. He was sentenced to 15 years with 18 months to serve. He pleaded guilty in 2009 to drug possession and was sentenced to five years in prison.
In 2005, he pleaded guilty to theft of property and received a 15-year suspended sentence. He pleaded guilty to forgery in 2001 and received a three-year sentence.
In addition to Johnson’s criminal history in state courts, Johnson was indicted by a federal grand jury in March 2012 on a charge of being a felon in possession of a Smith & Wesson .40 caliber pistol during a June 20, 2009 arrest in Winston County.
The indictment cited Johnson’s previous criminal convictions: a June 6, 2001 conviction in Cullman for possession of a forged instrument; an Aug. 15, 2001 conviction in Cullman County for second degree forgery; and a May 17, 2005 conviction in Cullman County for first degree theft of property.
Johnson pleaded guilty to the gun charge. He was sentenced to a year and one day in prison and a supervised release term of three years.
Johnson was arrested on January 11, 2016, for violating the terms and conditions of that supervised release. The next month, a federal magistrate judge sent him to federal prison for 12 months and a day.
According to the federal magistrate’s order: “After being placed on supervised release, defendant Johnson admitted to use of methamphetamine in January 2015. He was later placed in the Color-Code Random Urinalysis Program for drug testing. Defendant never showed up for the first drug test. He failed to report for drug testing in June, July, August, September, and October 2015. Defendant Johnson failed to appear for his test in August 2015 after having been specifically told to attend.
“Defendant Johnson is also supposed to report to his U.S. Probation Officer each month. He reported in October 2015, but he has failed to report since that time.”
The federal case against Johnson is part of Project Guardian, the Department of Justice’s signature initiative to reduce gun violence and enforce federal firearms laws. Initiated by the Attorney General in the fall of 2019, Project Guardian draws upon the Department’s past successful programs to reduce gun violence; enhances coordination of federal, state, local, and tribal authorities in investigating and prosecuting gun crimes; improves information-sharing by the Bureau of Alcohol, Tobacco, Firearms and Explosives when a prohibited individual attempts to purchase a firearm and is denied by the National Instant Criminal Background Check System (NICS), to include taking appropriate actions when a prospective purchaser is denied by the NICS for mental health reasons; and ensures that federal resources are directed at the criminals posing the greatest threat to communities.
Johnson’s arraignment on the federal charges is set for March 12. He is scheduled to appear in state court Thursday in connection with O’Rear’s slaying

Victim in Ashford shooting identified; law enforcement believes shooting is drug related
Houston County investigators released the name of a man killed in what they describe as a drug-related shooting in Ashford Sunday.
D’Travieon Barnes, 20, of Houston County, died from a single gunshot wound to the chest area.
Houston County Sheriff Donald Valenza would not elaborate on what led investigators to determine the shooting is drug-related because the investigation is active.
Deonte Latarus Gilmore, 20, was booked at the Houston County Jail at 7:14 a.m. Sunday. Bond has been set at $500,000.
Sheriff’s Maj. Bill Rafferty said authorities were called about midnight Saturday to a house in the 100 block of Harrison Street. Deputies located a man who was dead from a gunshot wound.
“At this time during the investigation, we have reviewed video footage that was captured by someone at the home when the shooting occurred,” Valenza said. “The video clearly shows Mr. Barnes strike the suspect with a laptop monitor. The video also shows, if slowed down for proper analysis, you can see Mr. Gilmore fall and then pull his gun out. The video shows Mr. Barnes kick Mr. Gilmore before the gun is fired.”
Valenza said he doubts the shooting can be characterized as self-defense under the state’s stand-your-ground law.
Deputies responded earlier Saturday to a nonemergency call regarding a noise complaint.

Man charged in Sunday’s fatal shooting requests appointed counsel
A Houston County man charged in the fatal shooting of D’Trav-ieon Barnes last weekend in Ashford has requested a court-appointed attorney.
Deonte Latarus Gilmore, 20, was booked into the Houston County Jail early Sunday morning.
According to court documents, Gilmore asked that District Judge Benjamin Lewis appoint an attorney to represent him in his murder case. Lewis appointed defense attorney Thomas Smith.
Investigators with the Houston County Sheriff’s Office have reviewed video footage captured by someone at the home when the shooting occurred.
“The video clearly shows Mr. Barnes strike the suspect with a laptop monitor,” said Houston County Sheriff Donald Valenza. “The video also showed, if slowed down for proper analysis, you can see Mr. Gilmore fall and then pull his gun out. The video shows Mr. Barnes kick Mr. Gilmore before the gun is fired.”
Valenza doubts the shooting can be characterized as self-defense under the state’s stand-your-ground law.
Gilmore is at the Houston County Jail on a $500,000 bond.

Ashford shooting stemmed from drug deal gone bad, sheriff’s office says
ASHFORD, Ala. (WDHN) — The Houston County Sheriff’s revealed the cause of Saturday’s fatal shooting in Ashford Tuesday afternoon.
According to an HCSO release, a drug deal went wrong at a house party on the 100 block of Harrison Street.
The victim — D’Travieon Ledarius Jawuan Barnes, 20, of Dothan — and suspect Deonte Latarus Gilmore got into a fight, which ended when Gilmore reportedly took a gun out and fired a round into Barnes’ chest.
Barnes ran away and fell outside the home’s garage door, having died from the injury.
This matches what is seen in a video of the incident, which shows the events leading up to and shortly after the shooting. You can read about that by following this link.
Gilmore is still in the Houston County Jail on a $500,000 bond for murder. He made his first appearance in court Monday.
The sheriff’s office also said the owner of the home where the shooting happened was actually out of town. It was a family member that threw the house party.

MONTGOMERY, Ala. (WSFA) - On Monday, Lowndes County Sheriff John “Big John” Williams will be laid to rest in Montgomery.
Williams was killed in a shooting Saturday night at a Hayneville gas station, and his community continues to mourn. According to a program for the funeral, Williams grew up in Lowndes County, graduating from Calhoun High School in 1976. He began his career in law enforcement in 1978, first volunteering as a reserve deputy, later working for the Hayneville Police Department, then serving as a deputy for the Lowndes County Sheriff Department. In 2010, he was elected sheriff, and he was reelected in 2014 and 2018.
Williams’ married Joann Williams in 1976, and the couple had two children.
“Meeting you John was like a gift from God, Marrying you John was the bond that united our hearts,” Joann Williams said in the program to her late husband. "The laughter, the joy, the tears and smiles, Together we shared them all and traveled many miles."
The Alabama Boys will perform at the funeral, and several people are scheduled to speak, including Montgomery County Sheriff Derrick Cunningham and Senator Doug Jones. See the full program below:

A well-known Lowndes County Sheriff was killed in the line of duty Saturday night in Hayneville, Alabama.
Sheriff John Williams, also known as “Big John,” was killed outside a QV convenience store at the intersection of Highway 21 and Highway 97 on Saturday around 8 p.m., according to AL.com.
Williams had responded to a call from the store owner who asked officers to disperse a group of people that were standing around outside the building.
Just after 10 p.m., the Alabama Law Enforcement Agency (ALEA) issued a Blue Alert for the suspect identified as 18-year-old William Chase Johnson, who was reportedly driving a stolen vehicle which he later abandoned.
However, Johnson returned to the scene of the alleged crime just after midnight carrying a handgun and was taken into custody. The ALEA then canceled the manhunt, according to Fox 5 Atlanta.
Saturday evening, Alabama Attorney General Steve Marshall announced the tragic loss on Twitter.
"Tonight, Alabama mourns the loss of Lowndes County Sheriff 'Big John' Williams, who was killed in the line of duty. Sheriff Williams dedicated over 40 years of his life to public safety, including 19 years as Sheriff. Please pray for his family and fellow officers. #ThinBlueLine"
The attorney general also issued a press release that read:
"Sheriff Williams is the fifth line-of-duty death of an Alabama law enforcement officer to gun firhe this year and the sixth to lose his life overall in our state over the last 11 months. Serving the public in the role of a peace officer is a difficult calling, fraugt with peril, yet thankfully many Alabama men and women choose to answer the call, often time putting their lives in danger to protect us. It simply cannot be said enough that we owe these heroes our gratitude and our support."
I know all Alabamians join me in passing along our condolences and prayers to Sheriff Williams’ family and to the Lowndes County Sheriff’s Office.
Johnson, who is from Montgomery and the son of a law enforcement officer, was arrested and charged in August for possession of brass knuckles and being a minor in possession of alcohol. However, those charges were later dismissed, court records said.
Michael Jackson, the district attorney for Alabama’s Fourth Judicial Circuit, called Williams a “great friend,” adding that “he was a great sheriff but an even better person.”
“He really cared about the Black Belt. He came over to Selma many times to help fight the gang problem,” Jackson concluded.

Police: Man wearing Halloween mask murders in Dothan
A man wearing an orange jumpsuit and Halloween mask fired shots that killed one person in an apparent murder case
The victim has been identified as 25-year old Bernard Bryant of Dothan.
Those living nearby told WTVY they heard several shots, possibly five or six. When police arrived they found the body of a man outside a home on Greenwood Drive.
“(The shooter) ran from the scene, the canine tracked him (but did not locate) him,” said Dothan Police Department Major Will Benny.
Police are not ruling out more than the masked man may have been involved in the shooting.
Investigators questioned neighbors and took at least one person to the police department for interrogation. It’s not known if that person is considered a suspect.
Late Thursday, they requested a ladder from the fire department to search the roof of at least one home.

DOTHAN, Ala. (WDHN) — Dothan police are searching for the person responsible for killing someone on Greenwood Drive Thursday afternoon.
A witness at the scene said there was an argument between a person and a driver that was circling around the block. After they finished, the driver reportedly went around and fired at the victim.
“(The suspect) was wearing an orange, yellowishm and some sort of matching Halloween-style mask,” Major Will Benny said. “He ran from the scene. The K-9s tracked him to a location, where we had a negative result in locating him. The search is ongoing at this time.”

Police arrest two and continue search for suspects in three shootings that left two dead
Dothan police have charged two men in connection with one of three shootings in less than 24 hours that left two victims dead and one hospitalized.
The third shooting occurred on Woodham Road just off Headland Avenue in Dothan about 10:20 p.m. Thursday.
“The victim has been identified as 38-year-old Rodney Caliste,” Dothan police Capt. Will Glover said. “At this time, we believe Mr. Caliste was shot one time to the head area.”
According to law enforcement, Caliste was shot outside his home near his driveway. A person who was allegedly inside the home when the shooting occurred was interviewed by investigators, and later determined not to be a suspect.
Caliste’s slaying follows two other apparently unrelated shootings in the city.
The first shooting occurred Thursday morning near the intersection of North Edgewood Drive and West Powell Street. Police arrested two local men Friday afternoon in connection to that shooting.
Michael Jones, 26, of Ashford, and Calvin Bivins, 29, of Dothan, are each charged with first-degree robbery and attempted murder.
“When the call originally came in, it was reported as a motor-vehicle accident,” Glover said. “It was determined, once officers arrived just after 2:40 a.m., it was actually an assault call. The victim had been shot once under the left arm area, and the bullet traveled through his chest. It appears the victim realized he was being robbed and tried to block the bullet.”
The victim is identified as Andrew Strange of Indiana. He is hospitalized.
Police believe Strange was traveling through town, and say the shooting could be related to a bad drug deal.
Around 2 p.m., officers were called to the 1200 block of Greenwood Drive by a report of another shooting.
“During the investigation, witnesses informed investigators the victim and several other people were outside sitting around a table talking when a male wearing a Halloween mask and orange clothing appeared from behind a privacy fence and fatally shot 25-year-old Bernard Bryant,” Glover said.
The bullet struck Bryant under the armpit area and the traveled into the chest area, killing him.
Glover said the shootings are not related.
“We are still investigating all three cases, and we are continuing our search for the suspects,” he said.

Rodney Fitzgerald Caliste was born May 11, 1981 in Dothan, Alabama at Southeast Alabama Medical Center to Cynthia “Tina” Caliste who preceded him in death.
Rodney became a member at Greater Beulah Baptist Church at a young age under the guidance of his loving and devoted mother “Tina”. Rodney was dedicated to his community and actively supported many charities. In his spare time, he mentored many young boys by rewarding them for reading business books, staying out of trouble and getting good grades.
Rodney relocated to Atlanta, Georgia as an adult and enjoyed travelling abroad to many countries.
Rodney had a passion for cooking and eating good food. He would often call himself an “Elite Chef,” and he engaged in cooking competitions with friends and family. During high school, he worked at Mikata Japanese Restaurant in Dothan. Later, Rodney enlisted in the United States Navy. From May 4, 2000 to June 6, 2003, Rodney worked as a Navy meteorologist. Rodney left the Navy to pursue his dreams of entrepreneurship and trying to improve his community. Along the journey of life, he had several successful business ventures, including being a Producer for the movie “Bring Out The Lady” under Double R Media. Rodney also later established an elite, respected dog kennel breeding business for one of the most prestigious breed of dogs, the Presa Canario. Breeding dogs was a highlight in Rodney’s life and he was very proud and dedicated to his kennel that was admired by many. He was a huge Dallas Cowboy football fan.
Rodney’s proudest achievement though was being a devoted father and provider for his children whom he adored. He was also an avid reader of self-improvement and self-empowerment books and he often quoted passages to his mentees, friends and family to inspire them to work smart, be good to others and be self-sufficient. Besides English, Rodney’s other languages were success and love! Rodney loved bettering himself and being able to help others.
Although he is no longer here on Earth, Rodney’s love, generosity and life lessons are continuing to impact his family and friends.
He was preceded in death by his parents and grandparents. Rodney was called home on October 24, 2019 in Dothan, Alabama.
Rodney took pride in being a loving and devoted father to his four children, but he also nurtured and provided for many, many others.

Police return to murder scene but mum on reason
Dothan police returned to the scene of an apparent murder Monday morning, presumably searching for additional evidence.
Officers used a fire department ladder to take photos through what appears to be a garage window of the home where 38-year old Rodney Caliste died October 24. He suffered one or more gunshot wounds to the head.
No arrests have been made.
They also could also be seen using what appeared to be metal detectors outside the home on Woodham Road.
What is being sought in that renewed search has not been made public but sources say new information may have altered dynamics of the investigation.
Police, on the night of the shooting, found a pistol lying on the ground in close proximity to Caliste's body.
Initial forensics tests on that gun and shell casings also found have been completed. What those tests revealed has not been released.
Caliste, from Dothan, also had ties to the Atlanta area. He was a small budget movie producer and involved in the music industry.
Court records reveal that, in 2006, he was convicted of cocaine trafficking in Houston County and a judge placed him on probation.

BREAKING: Dothan police make breakthrough in October murder case
DOTHAN, Ala. (WDHN) — Dothan police officers and Douglas County deputies arrested a new suspect in the shooting death of a Dothan man back in October.
On Oct. 24, 2019, Rodney Caliste was shot in the face outside his home on Woodham Drive. The suspect fled the area, and for months, investigators looked for whoever was responsible.
Their search eventually led them to Douglasville, Georgia, where the DPD and the Douglas County Sheriff’s Office’s Criminal Investigation Division found a suspect this week.
The suspect — Marcus Hubbard, 49, of Douglasville — was taken into custody while he left his home.
Authorities charged the man with one count of murder. According to Lt. Will Glover, Hubbard and Caliste were business associates.
The investigation is still in progress as law enforcement conducts searches in the area. Hubbard reportedly faces some narcotics charges related to search warrants in the case.
Another arrest is possible in the case as well. Should anything else develop today, we will update this story.

Douglasville Man Arrested On Alabama Murder Charge
DOUGLASVILLE, GA — A Douglasville man was arrested and charged with a 2019 Alabama murder, according to authorities. Marcus Hubbard, 49, is accused of the Oct. 24, 2019 murder of 38-year-old Rodney Caliste.
According to authorities, Hubbard was arrested while leaving his Douglasville home on Jan. 15. Authorities also carried out search warrants which resulted in narcotics charges for Hubbard.
Once the narcotics charges are complete, the Douglas County Sheriff's Office said, Hubbard will be extradited to Alabama.
The alleged murder took place in Dothan, Alabama, releases from Douglasville and Dothan authorities say.
The Dothan Police Department and Douglas County Sheriff's Office are working together on the case and more arrests related to the case are possible, the Dothan Police Department said.
